Please note that we do not control communications from others. If you have received marketing communications from third parties, you should contact those third parties directly to understand communication choices they may provide you. FourthWall collects and processes personal data to allow our customers and their representatives (“Customers”) to understand and analyze television, cable, satellite, broadcast, and device viewership data and to extract meaningful insights from such data. We provide our Customers with demographic data about specific TV programming and advertisements viewed by households and related reporting and tracking to understand the effectiveness of these programs and advertisements.

This Additional Notice applies to our collection and reporting services that we provide to our Customers (“Services”) and to our website (“Website”). This notice is addressed to our Customers, visitors to our Website (“Visitors”), and to the consumers whose data is collected and processed as a part of our Services to our Customers (“Consumers”). All capitalized terms not otherwise defined in this Additional Notice will have the meaning assigned to them in the Privacy Notice.

These disclosures and rights may not apply to data not processed by FourthWall or for which FourthWall does not determine the purposes and means of processing.   • Identifiers unique household identifier, household IP address, or other similar identifiers;

  • Usage data such as information on a consumer’s TV viewing, times and duration of viewing.

  • Protected classifications such as your household demographic information including age, gender, and other similar classifications. Additionally, we collect information about your household television and video viewing..

This provides insights regarding their advertising, campaigns and other promotions including the viewership of their ads and helps identify target audiences for additional advertising.

  • To maintain, analyze, customize, measure, and improve our Services, which includes generating internal reports about the use of our Services.

  • To send transactional communications, including requests for information, responses to requests for information, and other Service updates.

  • To provide customer support.

  • To communicate with our customers, including about products updates and offerings that we think they may be interested in.

  • For account management, finance, dispute resolution, and reporting purposes.

  • To monitor and enforce our legal terms or similar terms.

  • For internal business reasons, including internal audits or investigations, company research, insurance purposes.

  • To comply with law and satisfy our regulatory compliance obligations.

SALES OF PERSONAL INFORMATION

In the last 12 months we have disclosed Visitor and Consumer personal information to third parties in connection with operating and providing our Services, including network identifiers and inferences about your preferences to third party analytics providers. Such disclosure for analytics and marketing / advertising purposes constitutes a “sale” of your personal information under California law. You may opt out of the sale of your personal information by filling out the form Here. We do not sell the personal information of individuals who we know to be under 16 years of age. DATA STORAGE AND RETENTION

We will store your personal information until the initial purpose for which we collected such data has been satisfied, including the purpose described in our How Personal Information is Collected and Used section. If you consent to a new or additional purpose for retaining your data, your personal information may be stored for longer. We have implemented measures designed to secure your personal information against unauthorized use, loss, destruction or alteration. We cannot guarantee the security of your personal information.

We retain your data according to a set retention schedule, which is 5 years. At the end of that retention period, all data is deleted unless subject to an exception under law.

Upon verifying your identity, we will use reasonable efforts to correct your personal information as directed. In certain circumstances, we may not be able to satisfy a correction request depending on the nature of the personal information and purposes for maintaining it.

To exercise the right to opt out, you may submit a request to use by visiting our Do Not Sell or Share My Personal Information page. Once you make an opt-out request, we will wait at least twelve months before asking you to reauthorize personal information sales. You do not need to create an account with us to exercise your opt-out rights. Your right to opt-out of ‘sharing’ information is a specific right to prevent the provision of your personal information to a third party for them to target cross-context behavioral advertising to you.


“Cross-context behavioral advertising means the targeting of advertising to you based on the personal information obtained from the activity across businesses, distinctly branded internet websites, applications, or services, other than the business, distinctly branded internet website, application, or service with which you intentionally interact.

6) Right to Limit Use of Sensitive Personal Information. FourthWall does not collect information that is considered “sensitive” personal data.

We may not discriminate against you for exercising any of these rights. This means that we may not deny you services or charge you different prices or rates for services or provide you with a different level or quality of services (or suggest that we will do so), in response to a request. However, we may charge different prices or rates, or provide a different level or quality of services, where that difference is reasonably related to the value provided to us by your personal information.

You may designate an authorized agent to make a request to know, request to correct, or request to delete on your behalf. An agent may be an individual or a business entity. To designate an authorized agent, you must provide the agent with written permission to submit the request. We may still require you to verify your identity directly (subject to certain exceptions). We may refuse a request if the agent does not provide adequate proof of their authorization.

Under Colorado law, “sensitive data” is defined as personal data revealing racial or ethnic origin, religious beliefs, a mental or physical health condition or diagnosis, sex life or sexual orientation, or citizenship or citizenship status, genetic or biometric data that may be processed for the purpose of uniquely identifying an individual, or personal data from a known child.

FourthWall does not collect or otherwise process sensitive data under Colorado law.

If you are a Virginia resident, you have the following rights regarding your personal information.

 

  1. Right to Confirmation and Access. You have the right to confirm whether we are processing your personal information and to access such personal information.
     

  2. Right to Correct. You have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing.
     

  3. Right to Delete. You have the right to request that we delete your personal information that you have provided to us or that we have obtained about you.

If you have submitted a request regarding any of the rights listed above and you would like to appeal our decision or refusal to act on your requests, you may submit an appeal within a reasonable period of time.  To do so, you should contact us at the website link below and note in your message that you are appealing our decision.

 

We may limit our response to your request to exercise the above rights as permitted by law.
